1. Acceptance of Terms

By creating an account, streaming, viewing content, or otherwise using S.V.E.R, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines.

2. Account Responsibilities

When you create an account, you agree to:

• Provide accurate and truthful information
• Maintain the security of your login credentials
• Maintain only one account per person (alt accounts for ban evasion are prohibited)
• Be at least 13 years of age
• Not share your account with others
• Notify us immediately of any unauthorized access

You are responsible for all activity that occurs under your account.

3. Factions

S.V.E.R features three factions: Myria (discipline and earned ground), Aetheron (learning and mastery), and Glint (belonging and trust).

• Faction membership is a core part of the Platform experience
• Factions express identity and community, not content category
• Faction-related stats, standings, and leaderboard positions are publicly visible
• Your contributions affect your faction's overall ranking
• Your first faction choice is free, followed by 3 trial changes and then a 30-day cooldown between changes
• Faction wars and territory control events are competitive features

4. Streaming Conduct

When streaming on S.V.E.R, you agree to:

• No illegal content: Do not stream content that violates any applicable laws
• No harassment: Do not target, bully, or harass individuals on or off the Platform
• No hate speech: Do not promote violence or discrimination based on protected characteristics
• No NSFW without tagging: Adult content must be appropriately tagged and age-gated
• DMCA compliance: Only stream content you have rights to broadcast
• No dangerous activities: Do not stream content promoting self-harm or dangerous stunts
• No spam or manipulation: Do not artificially inflate metrics or mislead viewers

Violations may result in content removal, stream termination, or account suspension. See our Community Guidelines and DMCA Policy for details.

5. Username Policy

Usernames on S.V.E.R are subject to our negotiation system:

• Usernames are granted on a first-come, first-served basis
• OAuth-Verified Claims: Verified creators from Twitch, YouTube, Kick, or X can claim their username if held by another user
• Negotiation: Verified claims trigger a negotiation process where offers and counteroffers are exchanged
• Revenue Split: Successful negotiations result in a 70/30 revenue split (70% to the username holder, 30% to the Platform)
• Vanity URLs: Vanity URLs (e.g., sver.tv/v/yourname) are a privilege that can be revoked for violations
• Usernames containing hate speech, impersonation, or trademarked terms may be reclaimed without compensation

6. Monetization

Subscriptions and Tips

• Viewers can subscribe to creators and send tips/donations
• All payments are processed securely through Stripe
• Subscriptions currently split 80/20 between creators and the Platform
• Tips currently pay 100% to creators, with S.V.E.R absorbing payment processing fees
• Creator ad revenue currently splits 80/15/5 between creators, platform operations, and viewer rewards
• Creator merchandise markup currently splits 90/10 between creators and the Platform
• Creator payouts require Stripe Connect onboarding and are available after earnings clear

Valor Currency

• Valor is S.V.E.R's virtual currency
• Valor can be earned through engagement or purchased
• Valor can be used for tips, cosmetics, and platform features
• Valor has no cash value and is non-refundable except as required by law

Refund Policy

• Subscriptions may be canceled at any time; no prorated refunds
• Tips and donations are non-refundable except in cases of fraud
• Valor purchases are non-refundable except as required by law
• Chargebacks may result in account suspension pending investigation

Creator Revenue Splits

Current creator economics are disclosed publicly and may be updated over time with notice. Merchandise profit remains pending for 7 days after shipment confirmation before it becomes withdrawable.

7. Chat and Communication

• Chat is subject to our Community Guidelines
• Streamers and moderators can timeout, ban, or restrict users from their channels
• Direct messages (DMs) can be restricted in your settings
• Guild and faction chat are moderated by respective leaders
• Spam, harassment, and hate speech are prohibited in all communication features

Moderators have discretion to enforce rules. Decisions can be appealed through our support system.

8. Intellectual Property

Your Content

You retain ownership of content you create and stream on S.V.E.R. By using the Platform, you grant us a worldwide, non-exclusive, royalty-free license to:

• Host, display, and distribute your content on the Platform
• Create clips and VODs of your streams
• Promote your content on the Platform and in marketing materials
• Allow other users to interact with your content (chat, clips, reactions)

S.V.E.R Intellectual Property

The S.V.E.R name, logo, faction emblems, and Platform design are owned by S.V.E.R. You may not use our trademarks without written permission, except for fair use in commentary or reviews.

9. Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms or our Community Guidelines
• Engage in illegal activity
• Harass other users or staff
• Manipulate Platform systems (viewbotting, fraud, etc.)
• Evade previous bans

Upon termination:

• Your access to the Platform will be revoked
• Your content may be removed
• Pending payouts may be forfeited in cases of fraud
• You may appeal through our support system

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We are not responsible for:

• User-generated content on the Platform
• Loss of data or revenue due to technical issues
• Actions of other users
• Third-party services integrated with the Platform

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, S.V.E.R AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE PLATFORM.

Our total liability to you for any claims arising from your use of the Platform shall not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim, or (b) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless S.V.E.R and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your content
• Your violation of these Terms
• Your violation of any third-party rights

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits against S.V.E.R.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction for violations of intellectual property rights.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform or sending you an email. Your continued use of S.V.E.R after changes take effect constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically. The "Effective Date" at the top indicates when these Terms were last updated.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
